BACK TO SCHOOL SALE CAMPAIGN TERMS AND CONDITIONS

Introduction

The Back To School SALE Campaign (“Campaign”) will run from 18^th August 2022, 12:00AM (GMT+8) to 31^st October 2022 11:59PM (GMT +8) (“Campaign Period”). Honor Technology (Malaysia) Sdn Bhd (“HONOR”) reserves the rights to shorten or extend the Campaign Period at its sole discretion without prior notice.

Campaign Mechanism

1. Eligibility

In order to participate in this Campaign, the customers (“Customer(s)”) must be:

(i) individual(s) residing in Malaysia; and

(ii) eighteen (18) years of age and above as of 1^st October 2022.

2. Events

This Campaign consists of the following nine (7) events:

(a) Special Offers

(i) The HONOR products below are available for purchases made on HIHONOR Website during this Special Offers event. Customer(s) will be entitled to enjoy the special price (“Special Price”) and receive the corresponding free gifts as set out in the table below with purchase from 1^st October 2022 12:00AM (GMT+8) to 31^st October 2022 11:30PM (GMT +8):

(ii) Customer(s) can purchase the HONOR product(s) above under this Special Offers event from any of the participating stores below, please refer to the applicable terms and conditions of the relevant participating stores before placing your order with them:

a. HIHONOR Website.

b. Authorized online stores:

(iii) The HONOR product(s) and the corresponding free gifts above are available on a first-come-first-serve basis, while stocks last.

(iv) Each unit of HONOR product(s) Product purchased is entitled to receive one (1) unit of the corresponding Free Gift only (where applicable).

(v) All free gifts are not exchangeable for cash or other items and are non-transferable.

(vi) All free gifts are not covered by any warranty of HONOR.

(vii) HONOR reserves the rights to change and/or replace any corresponding free gifts with other gift of the same value.

(viii) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR’s standard warranty service terms as provided in HONOR’s Warranty Policy available at https://www.hihonor.com/my/support/warranty-policy/. In addition to the standard warranty, new HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions available at https://www.hihonor.com/my/support/content/en-us15824450/.

(ix) Customer(s) shall check on HIHONOR Website for any latest changes to the terms of the Warranty Policy which can be updated from time to time by HONOR.

(x) All free gifts are not covered by the standard warranty of HONOR.

(xi) All free gifts are available on a first-come-first-serve basis, while stocks last.

(xii) HONOR reserves the rights to change and/or replace any free gifts with another free gifts of the same value.

(b) Flash Sales

(i) The HONOR products below are available for purchases made on HIHONOR Website during this Flash Sales event. Customer(s) will be entitled to enjoy the flash sales price below (“Flash Sale Price”) and receive the corresponding free gifts (where applicable) as set out in the table below with purchase from 13^th October 2022 12:00AM (GMT+8) to 27^th October 2022 11:59PM (GMT +8) ("Flash Sales Dates"):

(ii) After successfully placing an order during this Flash Sales event on HIHONOR Website, the Customer(s) is entitled to enjoy the Flash Sales Price for the HONOR product(s) purchased under this Flash Sales event.

(iii) Each Customer(s) with the same account registered on HIHONOR Website can only purchase a maximum of one (1) unit of the HONOR product(s) purchased under this Flash Sales event for each day during this Flash Sales event.

(iv) The HONOR product(s) purchased under this Flash Sales event sold during this Flash Sales event are available on first-come-first-served basis, while stocks last.

(v) All free gifts are not exchangeable for cash or other items and are non-transferable.

(vi) All free gifts are not covered by warranty of HONOR.

(vii) HONOR reserves the rights to change any free gifts with gift of the same value.

(viii) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR’s standard warranty service terms as provided in HONOR’s Warranty Policy available at https://www.hihonor.com/my/support/warranty-policy/. In addition to the standard warranty, new HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions available at .

(ix) Customer(s) shall check on HIHONOR Website for any latest changes to the terms of the Warranty Policy which can be updated from time to time by HONOR.

(x) All free gifts are not covered by the standard warranty of HONOR.

(xi) All free gifts are available on a first-come-first-serve basis, while stocks last.

(xii) HONOR reserves the rights to change and/or replace any corresponding free gifts with another free gifts of the same value.

(c) Subscribe & Get Vouchers

(i) Under this Subscribe & Get Vouchers event, Customer(s) will get a RM10 off voucher (“Voucher”) by subscribing to HONOR’s newsletter at HIHONOR Website from 15^th September 2022 12:00AM (GMT+8) to 15^th October 2022 11:59PM (GMT +8), as follows:

(ii) The Voucher will be credited automatically into the eligible Customer’s HONOR Online Store account in the “Coupon” section under “My Account”.

(iii) Only one (1) Voucher can be used in a single transaction (i.e. for all the items in the same transaction).

(iv) The Voucher cannot be transferred or exchanged for cash.

(v) The Voucher is only valid for purchase made on HIHONOR Website during the Campaign Period. Any Voucher that are not used or redeemed by 15^th October 2022 will be expired automatically.

(vi) This Subscribe & Get Voucher event is only applicable to purchase made on HIHONOR Website.

(d) Grab Vouchers

(i) This Grab Vouchers event shall run from 10^th October 2022 (GMT+8) to 12^th October 2022 (GMT+8) (“Grab Vouchers Period”) on HIHONOR Website, Customer(s) will be entitled to collect the vouchers below (“Grab Vouchers”) during the Grab Vouchers Period:

(ii) Customer(s) must login to their account on HIHONOR Website during the Grab Vouchers Period to collect and redeem the Grab Vouchers.

(iii) Grab Vouchers will be credited automatically into eligible Customer’s account on HIHONOR Website in the “Coupon” section under “My Account”.

(iv) Only one (1) Grab Voucher can be used in a single transaction (i.e. for the entire shopping cart comprising that transaction).

(v) The Grab Vouchers cannot be transferred or exchanged for cash.

(vi) The Grab Vouchers are valid and must be redeemed from 10^th October 2022 to 12^th October 2022. Any Grab Vouchers not used by 12^th October 2022 will be expired automatically.

(vii) Only one (1) Grab Voucher can be used per order and the Grab Voucher is not stackable.

(viii) The Grab Vouchers event is applicable for the purchase made on HIHONOR Website only.

(e) Subscribe & Win Prizes

(i) This Subscribe & Win event will run from 16^th September 2022 12:00AM (GMT+8) to 25^th October 2022 11:59PM (GMT +8) ("Subscribe & Win Period").

(ii) Customers who subscribed to the HONOR Newsletter during the Subscribe & Win Period will stand a chance to win the prizes below (“SW Prizes”):

Winners of the SW Prizes will be selected by HONOR. Decisions of HONOR shall be final and binding.

(iv) Each (1) Customer(s) with the same registered account and/or same identity information with HIHONOR Website can win a maximum of one (1) unit of SW Prizes only.

(v) Winners of the SW Prizes notified via their email address or contact number (SMS) (as registered with HIHONOR Website) by 30^th October 2022.

(vi) Winners will receive a code via their email address. Winners are required to use the code to redeem the prizes within two weeks from the date of the code being sent to the email address.

(vii) The prizes will be forfeited for winners who did not redeem or claim the prizes within two weeks from the date of the code being sent to the email address.

(viii) All SW Prizes are not exchangeable for cash or other items, and are non-transferable.

(ix) All SW Prizes are not covered by warranty.

(x) All SW Prizes are subject to availability and HONOR reserves the right to substitute the SW Prizes with another of equivalent value.

(xi) This Subscribe & Win event is only applicable at HIHONOR Website.

(f) New Product Launch

(i) The New Product Launch will run from 18^th August 2022 21:30PM (GMT+8) to 31^st October 2022 11:59PM (GMT +8) (“New Launch Period”).

(ii) Customer(s) who purchased the HONOR new product below (“New Product(s)”) from any authorised online and offline stores set out in Paragraph (f)(iii) below during the New Launch Period will receive the following corresponding free gifts:

(iii) Customer(s) can purchase the New Product(s) through any of the channel below, please refer to the applicable terms and conditions before you place your order with them:

(a) HIHONOR Website.

(b) Authorized online stores:

(c) Any other authorized offline stores.

(d) The purchase terms and conditions for this New Product Launch event may vary from different channels, kindly refer to the relevant stores for the applicable purchase terms and conditions before placing your order.

(iv) Any HONOR New Product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR’s standard warranty service terms as provided in HONOR’s Warranty Policy available at https://www.hihonor.com/my/support/warranty-policy/. In addition to the standard warranty, new HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions available at https://www.hihonor.com/my/support/content/en-us15824450/.

(v) Customer(s) shall check on HIHONOR Website for any latest changes to the terms of the Warranty Policy which can be updated from time to time by HONOR.

(vi) All free gifts are not covered by the standard warranty of HONOR.

(vii) All free gifts are available on a first-come-first-serve basis, while stocks last.

(viii) HONOR reserves the rights to change and/or replace any free gifts with another free gifts of the same value.

(g) Deepavali Roadshow

(i) Customer(s) who purchased any eligible HONOR Products (“Eligible HONOR Products”) below during the Deepavali Roadshow event (“Roadshow Period”) are entitled to redeem the free gifts below:

General

(i) The Customer(s) agrees and consents to HONOR for the use of any of the Customer(s) personal data for the purpose of participation in this Campaign in accordance with the applicable Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed and be used by HONOR for lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management of this Campaign.

(ii) By providing the personal data, the Customer(s) confirms that (a) he/she agrees and consents to the collection, processing and transfer of your personal data in accordance with the applicable Personal Data Protection laws and regulations; and (b) he/she has read, understood and agreed to be bound by HONOR Platform Privacy Statement and HONOR’s Marketing Activities Privacy Statement. The Customer(s) further agrees that HONOR and/or its agent and/or its third party service providers may contact the Customer(s) by telephone, email or such other method in connection with this Campaign.

(iii) In the event that any prizes or free gifts are being given to the Customer(s) having provided false or mistaken identity or information, HONOR shall have the right to revoke the Customer’s eligibility for the said prizes or free gifts.

(iv) By participating in this Campaign, Customer(s) agree to be bound by this Terms and Conditions and HONOR’s decisions are final and binding. No correspondence or appeals will be entertained. HONOR reserves the right to the final and ultimate interpretation of this Campaign.

(v) In accepting any prizes or free gifts, the winners agree to participate and cooperate as required in all editorial activities relating to the Campaign. The winners agree to grant HONOR a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winners will not be entitled to any fee for such use.

(vi) HONOR assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

(vii) HONOR shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Customer(s) in connection or arising from acts or omissions or in any way related to this Campaign.

(viii) The Customer(s) agrees to discharge and release HONOR from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or to the Customer’s entry in this Campaign.

(ix) The Customer(s) further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook and other social media platform, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign.

(x) Save where it is otherwise prohibited by the applicable laws, in no event shall HONOR be liable to any party including the Customer(s) for any claims relating to the Campaign and/or any activities operated by authorized online and offline stores and any service providers appointed by them, nor shall HONOR be held responsible for any payment made by the Customer(s) to authorized online and offline stores and any service providers appointed by them, or for the fulfilment of the sales transaction by such parties.

(xi) Without prejudice to the foregoing and save where otherwise prohibited by law:- (1) in no event shall HONOR be liable to any party including the Customer(s) for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, howsoever remote even if such losses were foreseeable or if HONOR was advised of the possibility of such damages; and (2) if HONOR is adjudicated by a local court of competent jurisdiction to be liable for any losses or damages arising out of or is in any way connected to this Campaign and any events therein, HONOR’s total liability shall in no event exceed RM50.00.

(xii) By participating in this Campaign and any events therein, the Customer(s) agrees to indemnify and hold HONOR and HONOR Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by HONOR due to or in any way arising from this Campaign.

(xiii) If Customer(s) are discovered to be using or have used improper means to participate in this Campaign and any events therein, HONOR reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

(xiv) Where any HONOR product(s) purchased during the Campaign Period is returned to HONOR in accordance with its standard return policy, all free gifts received for the purchase must also be returned together with the HONOR product(s).

(xv) HONOR reserves the rights to modify or cancel the terms and conditions at any time without further notice.

(xvi) This Campaign and the terms and conditions herein shall be governed by the laws of Malaysia.
