HONOR X9b 5G CAMPAIGN TERMS AND CONDITIONS

Introduction

This HONOR X9b 5G Campaign (“Campaign”) will run from 13^th October 2023, 12:00 AM (GMT+8) to 19^th November 2023 11:59 PM (GMT +8) (“Campaign Period”). Honor Technology (Malaysia) Sdn Bhd (“HONOR”) reserves the right to shorten or extend the Campaign Period at its sole discretion without prior notice.

Campaign Mechanism

1. Eligibility

To participate in this Campaign, the Customer(s) (“Customer(s)”) must be:

(i) individual(s) residing in Malaysia; and

(ii) eighteen (18) years of age and above as of 13^th October 2023.

2. Events

This Campaign consists of the following one (1) event:

(a) Play, Subscribe & Win Prize

(i) This Play, Subscribe & Win Prize event will run from 13^th October 2023 at 12:00 AM (GMT+8) to 26^th October 2023 at 11:59 AM (GMT +8) (“Play, Subscribe & Win Period”) on https://www.honor.com/my/shop/new-launch/.

(ii) Customer(s) who patriciate the puzzle game and subscribed to the HONOR Newsletter during the Play, Subscribe & Win Period will stand a chance to win the prizes below ("Play, Subscribe & Win Prize”): -

(iii) To stand a chance to win the prize, Customer(s) must patriciate the puzzle game and subscribe within the Play, Subscribe & Win Period on https://www.honor.com/my/shop/new-launch/. One (1) winners of the Subscribe & Win event shall be selected by HONOR. Decisions of HONOR shall be final and binding.

(iv) Each (1) Customer(s) with the same registered account and/or same identity information with HIHONOR Website or My HONOR App can win a maximum of one (1) unit of Play, Subscribe & Win Prize only.

(v) Winners of the Play, Subscribe & Win Prize will be notified via their email address (as subscribed with HIHONOR Website or My HONOR App) on the relevant announcement date.

(vii) The prizes will be forfeited for the winner who did not redeem or claim the prizes within two weeks from the date of the contacting email being sent to the email address.

(viii) Play, Subscribe & Win Prize is not exchangeable for cash or other items and are non-transferable.

(ix) Play, Subscribe & Win Prize is not covered by any warranty of HONOR.

(x) Play, Subscribe & Win Prize is subject to availability and HONOR reserves the right to substitute the Play, Subscribe & Win Prize with another prize of similar value.

(xi) This Play, Subscribe & Win event is only applicable at HIHONOR Website and My HONOR App.

(xii) Customer(s) shall check on HIHONOR Website and My HONOR App or any latest changes to the terms of the Warranty Policy which can be updated from time to time by HONOR.

(b) Early Bird Special (RM9 Deposit)

(i) The Early Bird Special (RM9 Deposit) event (“Early Bird Special Event”) will run from 27^th October 2023 9:00 AM (GMT+8) to 31^st October 2023 11:59 PM (GMT +8) (“Early Bird Special Period”).

(ii) After paying RM9 deposit, Customer(s) are required to complete the purchase transaction of HONOR X9b 5G within the period stipulated below. Upon completing the purchase, Customer(s) will receive the following exclusive gifts:

(iii) Customer(s) who purchased the HONOR X9b 5G during the Early Bird Special Period will stand an additional chance to get prizes below provided that the Customer(s) have fulfilled all the criteria below:

(a) Customer(s) must pay RM 9 deposit and the balance amount as well as completing the purchase transaction of HONOR X9b 5G in the manner below:

• For online purchase, the RM 9 deposit order will be confirmed as delivered and the voucher code will be sent to the email provided when placing order within next working day. The voucher can be used on HIHONOR Website during the Full Payment Pre-order Period (as defined below).

• For in-store pickup, the pickup code will be sent via SMS and email. Customer(s) are required to provide the pickup code to the relevant pick-up store for verification during Open Sales.

(b) Thereafter, Customer(s) will stand a chance to get the following prizes:

(iv) For Customer(s) who made purchase on HIHONOR Website, the exclusive gift will be delivered separately. Customer(s) will not be entitled to the exclusive gift if Customer(s) did not use/apply RM9 off voucher when placing order upon checkout:

(v) Winners will be selected by HONOR subject to the terms and conditions set out in these Terms and Conditions. Decisions of HONOR are final and binding.

(vi) RM9 deposit cannot be used for any models or products other than for the purchase of HONOR X9b 5G, and it is non-refundable or exchangeable for cash or other items.

(vii) The RM9 deposit voucher must be redeemed by latest 19^th November 2023 11:59 PM (GMT +8) and any unused RM9 deposit voucher will be expired automatically.

(c) RM9 Pre-order

(i) The RM9 Pre-order event (“RM9 Pre-order Event”) will run from 1^st November 2023 7:45PM (GMT+8) to 9^th November 2023 11:59PM (GMT +8) (“RM9 Pre-order Period”).

(ii) After paying RM9 deposit, Customer(s) are required to complete the purchase transaction of HONOR X9b 5G within the period stipulated below. Upon completing the purchase, Customer(s) will receive the following exclusive gifts:

(iii) The purchase terms and conditions and free gifts under this event may vary from different channels, kindly refer to the relevant stores for the applicable purchase terms and conditions before placing your order.The arrival time of pre-order gifts at each store is subject to the actual situation of the stores.

(iv) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR's standard warranty service terms as provided in HONOR’s Warranty Policy. In addition to the standard warranty, any HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions. For the selected HONOR products purchased during the Campaign Period that come with the 180 days Screen Crack Protection, please note that the 180 days Screen Crack Protection are subject to the Service Terms and Conditions.

(v) Customer(s) shall check on HIHONOR Website for any latest changes to the terms of the Warranty Policy which can be updated from time to time by HONOR.

(vi) All free gifts are not covered by the standard warranty of HONOR.

(vii) All free gifts are available on a first-come-first-serve basis, while stocks last.

(viii) HONOR reserves the rights to change and/or replace any free gifts with another free gifts of the similar value.

(d) Full Payment Pre-order

(i) The Full Payment Pre-order event (“Full Payment Pre-order Event”) will run from 1^st November 2023 7:45PM (GMT+8) to 9^th November 2023 11:59PM (GMT +8) (“Full Payment Pre-order Period”).

(ii) Customer(s) who purchased the HONOR X9b 5G during the Full Payment Pre-order Event from any of the channel listed in Paragraph (iii) below will receive the following free gifts:

(iii) The purchase terms and conditions and the free gifts under this event may vary from different channels, kindly refer to the relevant stores for the applicable purchase terms and conditions before placing your order. The arrival time of pre-order gifts at each store is subject to the actual situation of the stores.

(iv) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR's standard warranty service terms as provided in HONOR’s Warranty Policy. In addition to the standard warranty, any HONOR product(s) purchased during this Campaign Period will be entitled to 1 Year Extended Warranty as per terms and conditions of the Service Terms and Conditions. For the selected HONOR products purchased during the Campaign Period that come with the 180 days Screen Crack Protection, please note that the 180 days Screen Crack Protection are subject to the Service Terms and Conditions.

(e) HONOR X9b Open Sale

(i) This HONOR X9b Open Sale event (“HONOR X9b Open Sale Event”) will run from 10^th November 2023 10:00AM (GMT+8) to 19^th November 2023 11:59PM (GMT +8) (“HONOR X9b Open Sale Period”).

(ii) Customer(s) who purchased the HONOR X9b 5G during the HONOR X9b 5G Open Sale Event Period from any of the channels listed in Paragraph (iii) below will receive the following free gifts:

(iii) The purchase terms and conditions and the free gifts under this event may vary from different channels, kindly refer to the relevant stores for the applicable purchase terms and conditions before placing your order.The arrival time of pre-order gifts at each store is subject to the actual situation of the stores.

(iv) Any HONOR product(s) purchased during the Campaign Period shall be subject to the same terms as HONOR's standard warranty service terms as provided in HONOR’s Warranty Policy. General

(i) The Customer(s) agrees and consents to HONOR for the use of any of the Customer(s) personal data for the purpose of participation in this Campaign in accordance with the applicable Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed and be used by HONOR for a lawful purpose directly related to the running of this Campaign including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management of this Campaign.

(ii) By providing the personal data, the Customer(s) confirms that (a) he/she agrees and consents to the collection, processing and transfer of your personal data in accordance with the applicable Personal Data Protection laws and regulations; and (b) he/she has read, understood and agreed to be bound by Statement About HONOR Platform and Privacy and HONOR’s Marketing Activities Privacy Statement. The Customer(s) further agrees that HONOR and/or its agent and/or its third-party service providers may contact the Customer(s) by telephone, email or such other method in connection with this Campaign.

(iii) In the event that any prizes or free gifts are being given to the Customer(s)' having provided a false or mistaken identity or information, HONOR shall have the right to revoke the Customer’s eligibility for the said prizes or free gifts.

(iv) By participating in this Campaign, Customer(s) agree to be bound by this Terms and Conditions and HONOR’s decisions are final and binding. No correspondence or appeals will be entertained. HONOR reserves the right to the final and ultimate interpretation of this Campaign.

(v) In accepting any prizes or free gifts, the winners agree to participate and cooperate as required in all editorial activities relating to the Campaign. The winners agree to grant HONOR a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winners will not be entitled to any fee for such use.

(vi) HONOR assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

(vii) HONOR shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Customer(s) in connection or arising from acts or omissions or in any way related to this Campaign.

(viii) The Customer(s) agrees to discharge and release HONOR from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign or the Customer’s entry in this Campaign.

(ix) The Customer(s) further agrees to discharge and release any third party which is related to and connected with this Campaign, including Facebook and other social media platform, from any liabilities and claims (including from breach of contract, tort, negligence, or any other cause of actions at law or equity) arising out of or in any way connected to this Campaign.

(x) Save where it is otherwise prohibited by the applicable laws, in no event shall HONOR be liable to any party including the Customer(s) for any claims relating to the Campaign and/or any activities operated by any authorized online and offline stores and any service providers appointed by them, nor shall HONOR be held responsible for any payment made by the Customer(s) to any authorized online and offline stores and any service providers appointed by them, or for the fulfilment of the sales transaction by such parties.

(xi) Without prejudice to the foregoing and save where otherwise prohibited by law:- (1) in no event shall HONOR be liable to any party including the Customer(s) for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, howsoever remote even if such losses were foreseeable or if HONOR was advised of the possibility of such damages; and (2) if HONOR is adjudicated by a local court of competent jurisdiction to be liable for any losses or damages arising out of or is in any way connected to this Campaign and any events therein, HONOR’s total liability shall in no event exceed RM50.00.

(xii) By participating in this Campaign and any events therein, the Customer(s) agrees to indemnify and hold HONOR and HONOR Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by HONOR due to or in any way arising from this Campaign.

(xiii) If Customer(s) are discovered to be using or have used improper means to participate in this Campaign and any events therein, HONOR reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

(xiv) Where any HONOR product(s) purchased during the Campaign Period is returned to HONOR in accordance with its standard return policy, all free gifts received for the purchase must also be returned together with the HONOR product(s).

(xv) HONOR reserves the right to modify or cancel the terms and conditions at any time without further notice.

(xvi) This Campaign and the terms and conditions herein shall be governed by the laws of Malaysia.
