Terms and Conditions for [HONOR Beta Experiencer Program]

Welcome and thank you for your interest in participating in the [HONOR Beta Experiencer Program] (“Program”).

Your participation means a lot to us! By participating in this Program, you will stand a chance to win the latest HONOR Magic V3.

Program Details:

• Registration Period: 31st July 2024 – 18th August 2024

• Program Period: August 2024 – October 2024

• Number of HONOR Experiencers: 20 Experiencers (“Experiencers”)

• Mission: HONOR will provide the Experiencers with brand new, unlaunched smartphone – HONOR Magic V3, the Experiencers are encouraged to use the smartphone as a primary phone and as often as possible.

• Goal: Experiencers are encouraged to provide feedback as much as possible by raising tickets. By providing feedback, you will stand a chance to win HONOR Magic V3!

Prizes:

• 1x HONOR Magic V3 (10 units available to be won)

• 1x RM700 Voucher (20 units available to be won)

Participants who have successfully completed the Program will be eligible to receive a RM700 Voucher (“Voucher”). The Voucher can be redeemed on the official HONOR website towards the purchase of an HONOR Magic V3. Please note that the Voucher will only be distributed after the end of the Program.

How to Win:

• Experiencers can provide feedback on the pre-release software version about the performance, functionality and user experience by raising tickets through the HONOR Beta app.

• Each ticket submission earns 1 point, with an additional 0.5 points for attached videos/images. Depending on the importance of the issue reported, there may be opportunities for additional points. HONOR reserves the right for final interpretation of these terms and conditions. (Detailed training on how to use the app will be provided later.)

Terms & Conditions

HONOR will select 20 Experiencers from all eligible entries based on the feedback and effort demonstrated in their responses submitted via the Recruitment Page.

By entering this Program, the selected Experiencers agree to indemnify and hold HONOR and the HONOR Group of Companies, including their officers, directors, shareholders, predecessors, successors in title, employees, agents, and representatives, harmless from any claims, losses, damages, liability, expenses (including legal fees), suffered or incurred due to or arising from this Program or the Experiencer's participation therein.

HONOR will contact the 20 selected Experiencers via WhatsApp. Experiencers hereby consent to the disclosure of their names on HONOR's social media channels.

Selected Experiencers must respond and accept the participation opportunity within 48 hours of receiving notification. Failure to accept within this period will result in forfeiture of the opportunity, and a new participant will be selected from remaining eligible entries.

Selected Experiencers are required to sign the Beta Testing Agreement before receiving the device.

HONOR will contact the winners of this Program via WhatsApp. And winners hereby give consent to the disclosure of their name on Honor’s social media channels.

This Program is open to all residents of Malaysia, at least 18 years old as of 1st August 2024 with a valid National Registration Identification Card (NRIC) number at the time of participation of the Program.

HONOR Malaysia has full rights to use and publish all photos submitted in the Program without any prior notice to the relevant Experiencers and the Experiencers shall not be entitled to claim ownership or other forms of compensation on any such materials used by HONOR.

Employees of HONOR, their immediate families, Honor’s Advertising, Creative and Public Relations agencies, program organizer, their employees and immediate families are not eligible to participate in this program.

HONOR, its employees, promoters, program organizer shall not be liable for any loss, damage, or any injury that may be sustained by the Experiencers or by any person in connection with the program. All winners assume liability for any loss, injury, damage or claim that may arise from participating in the Program or use or redemption of any prize.

The Experiencers confirms that they have read, understood, and agreed to the HONOR’s Marketing Activities Privacy Statement Privacy Policy and provide consent to HONOR to the use of any personal data as provided by the Experiencers for the purpose of participation in this program in line with the Personal Data Protection Act 2010, to the extent that any personal data provided shall only be processed and be used by HONOR for lawful purpose directly related to the running of this program including but not limited to the purposes of User Experience enhancement, promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Program.

Winner(s) may be required to participate in a photo taking session during the issuance of the Prizes. Pictures captured may be used for commercial marketing purposes.

Only entries that do not contravene any laws and do not feature religious, sexual, violent, pornographic content or drugs will be included in the competition.

Prizes shown on any communication materials may defer in terms of color, specifications or design.

Winners shall be responsible for all costs in connection with the collection, delivery of his/her prize, including but not limited to legal cost, stamp duties, registration and transfer fees, taxes, insurance, spending money and related expenses (such as meals or personal expenses, upgrades, etc.) or fees.

Prizes are not exchangeable, transferable or redeemable in any form for whatever reason. Winners are solely responsible for the collection of their prizes.

In the event any prizes are being awarded to the experiencer having provided false or mistaken identity or information, HONOR shall have the right to revoke the experiencer’s eligibility for the said prizes.

All prize images are for reference only. Prizes shown and/or represented for the running of this Program shall be subjected to availability. Prizes given are non-refundable. Quality issues with regards to the condition of the Prizes are subject to 1 year standard warranty process provided by the relevant supplier/manufacturer of the said prize items.

Winner(s) shall not substitute any prizes won or exchange the said Prizes for money. HONOR reserves all rights in its sole discretion to substitute any prizes (or prize component, if applicable) with one of equal or greater value. HONOR is responsible only for the delivery of the Prizes and is not responsible for the condition and fitness of the said Prizes. Any imposition of taxes, fees, and any other costs associated with the acceptance and use of the Prizes are the sole responsibility of the winner(s).

By participating in the Program, the Experiencers agree to be bound by the Terms and Conditions of this Program and Honor’s decisions are final and binding. No correspondence or appeals will be entertained. HONOR reserves the right to the final and ultimate interpretation of this Program.

By entering your email address, participants agree to receive the latest offers and information on HONOR products, events and services from HONOR.

By entering, participants also agree to provide their personal information which will be used and disclosed by HONOR and its authorised agents for the purposes of Program administration and prize fulfilment. Personal information collected by HONOR is subject to the HONOR’s Privacy Statement. Participants can unsubscribe at any time after the Program has ended.

Users are obligated to cooperate with HONOR Malaysia in recording videos or sharing content on social platforms.

In accepting the Prizes, the winner(s) agree to participate and co-operate as required in all editorial activities relating to the Program. The winners agree to grant HONOR a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the winners will not be entitled to any fee for such use.

HONOR assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

HONOR shall not be responsible for any losses or damages directly or indirectly incurred by any party including the participants in connection or arising from acts or omissions or in any way related to this Program.

The participant agrees to discharge and release HONOR from any liabilities and claims (including from breach of contract, tort, negligence, or any other cause of actions at law or equity) arising out of or in any way connected to this Program or to the participant’s entry in the Program.

The participant further agrees to discharge and release any third party which is related to and connected with this Program, including Facebook, from any liabilities and claims (including from breach of contract, tort, negligence, or any other cause of actions at law or equity) arising out of or in any way connected to this Program or to the experiencer’s entry in the Program.

Without prejudice to the foregoing:- (i) save where otherwise prohibited by law, in no event shall HONOR be liable to any party including the Program for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, howsoever remote even if such losses were foreseeable or if HONOR were advised of the possibility of such damages; and (ii) if HONOR is adjudicated by a local court of competent jurisdiction to be liable for any losses or damages arising out of or is in any way connected to this Program, Honor’s liability shall in no event exceed RM1000.00.

By entering into this Program, the Experiencers agree to indemnify and hold HONOR and the HONOR Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents, and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by HONOR due to or in any way arising from this Program or the participant’s entry in the Program.

If the Experiencers are discovered to be using or have used improper means to participate in this Program, HONOR reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

The Experiencers must notify HONOR of any abnormalities or damages to the given phone by sharing photos of the abnormalities or damages of the given phone. HONOR reserves the right to require the Experiencers to compensate for all losses.

This Program and the Terms and Conditions herein shall be governed by the laws of Malaysia.

HONOR always reserves all the rights to modify or amend the Terms and Conditions of this Program.
